صبي من الكونغو محتجز في سجن مصري منذ عام

بحسب الرسالة المرفقة فإن صبيا من الكونغو -مواليد ديسمبر ١٩٩١- محتجز في السجون المصرية منذ اغسطس ٢٠٠٧ حيث قضى عاما في سجن القناطر للرجال كعقوبة لدخوله البلاد بصورة غير مشروعة، واخبرته السلطات المصرية مؤخرا أنه سيرحل لأسوان في العشرين من اغسطس الجاري لتأدية عقوبة أخرى لمدة ٣ أشهر وغرامة٢٠٠ جنيها مصريا.

فإن الصبي ليس لديه أوراق هوية ويعد “بدون جنسيةstateless
وتعذر توثيق هويته بسبب كون عائلته من قبيلة التوتسي وفرت من العنف في الكونغو الديموقراطية في يناير ٢٠٠٠ ثم فر معها الى رواندا حتى يونيو ٢٠٠٧ قبل ان تتفرق العائلة وينتقل هو عبر السودان الى مصر دون وثائق.

I am writing you today to draw your attention to an urgent case of a stateless child being detained in Egyptian prisons. In brief, my client's name is Usama Mohammed Bashir, (birth name Rich Steven Wambogo). His date of birth is 10 December 1991. He is from the Banyamulenge tribe in Congo (ethnic Tutsi in DRC). He has no identification papers as his tribe was unable, until recently, to obtain identification from the Congolese government (they are considered enemy outsiders). My client fled violent attacks on his home in DRC in January 2000. His entire family was killed in the attack on his home. He went to Burundi and lived there for 7 years with a neighbour/friend. In the beginning of June 2007, the Forces Nationales de liberation (FNL) in Burundi attacked his home and he fled to Egypt alone, via Rwanda, Uganda and Sudan.

When he approached the Egyptian authorities asking to be directed to the offices of the United Nations, he was detained and imprisoned for illegal entry into Egypt in August 2007. He has served a one year sentence in Qanatir prison, with adults. The Egyptian authorities refuse to release him since he is stateless and has no identification papers. He will be transferred to Aswan to serve an additional 3 month term there on 20 August 2008. The authorities have informed him that they intend on keeping him there for a period of 3 months. The have also asked him to pay a 2 000 LE fine. It seems that the authorities are undecided as to what to do with him at the end of his sentence. Since he is stateless and has no money, they have nowhere to deport him to and no way to buy a ticket. Since he has no ID papers, they are unwilling to release him in Egypt.

I have submitted the information regarding his case to the United Nations High Commission for Refugees in Cairo and have urged them to interview him to determine his refugee status. I am also sending it to:
